MILTON KING Commissioner to ROBERT CARTER
This Indenture made and entered into this 4th day of June 1847 Between
MILTON KING Commissioner of the one part and ROBERT CARTER of the other
part. Witnesseth. Whereas by a Decree of the Cumberland Circuit court,
Rendered at the April Term 1838 in Suite in Chancery therein pending
between GREEN CARTER, EVANS CARTER and JOSEPH CARTER Complts. Against
ROBERT CARTER, JAMES H. CARTER and DAVID CARTER defts, Said KING was
appointed Commissioner to Collect and distribute the money arising from
the Sale of the lands in the bill of the Complts. mentioned, among those
entitled, and Convey the land to the purchaser on the payment of the
money, for and on behalf of the Heirs Complts and defendants of SAMUEL
CARTER deceased. And whereas the Said Grantee ROBERT CARTER, being one
of the purchasers of Some of the lands So Sold, to wit, to the number of
One Hundred & eleven acres & JOSEPH CARTER became the purchaser of the
Remainder of the lands decreed to be Sold as Aforesaid, and the Said
Purchasers having paid their Respective Amounts of purchase. Now being
it further Witnessed, That the Said KING, Commissioner aforesaid by
Virtue of and pursuant to Said decree, and in Consideration of the
purchase and payment aforesaid and furthermore, by virtue of and
agreeable to a divisional line made by & between the Said purchasers,
which agreement is evidenced by writing on file in Said Chancery
papers. The Said KING Commissioner as aforesaid doth by thee presents
convey to the Said ROBERT CARTER and his heirs, a certain tract or
parcel of land Situate lying & being in the county of Cumberland, State
of Kentucky, on ALLENS CREEK, and bounded as follows viz:
Beginning at a hickory and ash Corner of the Original tract of 106
acres deeded by JNO FUDGE to SAMUEL CARTER, thence with a line of the
Same S 115 poles to an ash Sugar tree and white Oak, on the top of a
ridge S 78° W 80 poles to a hickory on the side of a branch, thence down
the Same S 38 W 20 poles to a planted Stone, near the grave yard N 59 W
26 poles to a large black gum, N 25 W 28 poles to a large elm, S 78 W 20
poles to a stake on the point of a ridge N 37 ½ W 18 poles to a hickory
and Sugar tree, N 34 ½ W 16 poles to a sugar tree & beech saplings, N 66
W 16 poles to a hickory and elm, on the top of a hill, and in the line
of the said 106 acres tract, N 35, E 28 poles to a stake corner of the
50 acre tract, Surveyed in the name of JOHN FUDGE and deeded by him to
SAML CARTER, thence with a line of Same N 25 W 80 poles to a hickory and
fallen sugar tree, Corner to Same, thence with another line of Same __
poles to a beech and white Oak corner to Same __ with another line of
Same to the Beginning. Containing by Survey One Hundred and eleven
acres, the Same more or less.
To have and to hold the Same with all and Singular, the privileges ad
appurtenances thereto belong or in any wise appertaining unto him the
Said ROBERT CARTER and his heirs forever, and the Said KING Commissioner
as Aforesaid for and on behalf of the Heirs of SAMUEL CARTER deceased
doth Covenant and agree to and with Said ROBERT CARTER to warrant and
defend the title to Said land hath Conveyed, from and against the claim
of Said heirs and all persons claiming by through or under them.

Kentucky Cumberland Circuit S.S. I MILTON KING clerk of the Circuit
Court for the County Aforesaid, Do Certify that the foregoing deed from
MILTON KING Commissioner for and on behalf of the heirs of SAMUEL CARTER
decd to ROBERT carter, was produced in Open Court at the July term 1847
and acknowledged by Said KING Comr as aforesaid, to be his act and deed
for the purposes therein named, and the Same was __ed to be Certified to
the clerk of the Cumberland County court for Recorded which is
accordingly done. Given under my hand this 1_th day of July 1847. M.

for Said County Do Certify that I have truly Recorded the foregoing deed
of Conveyance from MILTON KING Commissioner to ROBERT CARTER, together
with the Official Certificate thereon endorsed, with this my Certificate
in my Said Office in deed book L page 160. Given under my hand this
