which reminded me of the Greatest Rev War/founding of this country Caswell W'ton
story I know, which I have in other circumstances described as the Story of the Theft of
the Federal Convention Ballot Box, written by William S. Powell.
[Incidently, the actual votes of the American/ NC citizens who voted were recorded (in
a columnar format), (now at:
http://ftp.rootsweb.com/pub/usgenweb/nc/dobbs/misc/vote1788.txt)
and published, (at least for those who voted before the Theft), perhaps a first and, as
far as I know, last recordation of a citizen's actual federal vote].
Unfortunately, I found no Rices involved, but in deference to the Rice email refd in
the msg pointed out to me, see below, here 'tis FYI. Hopefully, if a Rice researcher
is involved somehow, someone on Rice-L will know and advise us. The story is of LENOIR Co
(then or now Dobbs? Co) origin.

Annals of Progress, the Story of Lenoir County and Kinston, North Carolina,

The Election in 1788 was held for delegates to attend a convention in Hillsboro for the
purpose of accepting or rejecting the proposed Federal Constitution. Sentiment against
Federalism was particularly strong in Dobbs County. The Federalist ticket in the county
was made up of Richard Caswell, James Glasgow, Benjamin Sheppard, Bryan Whitfield and John
Heritage. The Anti-Federalist ticket was less distinguished but more popular. While the
ballots were being counted in the Courthouse at night following the election, it was noted
that the Anti-Federalist ticket was leading by a substantial margin. Suddenly the light
was extinguished and the ballot box disappeared so that the Sheriff [who just happened to
be: Benjamin Caswell Sheriff of Dobbs County & bro of Federalist candidate Richd
Caswell bw 12/2003], charged with counting the ballots, declared himself unable to
determine which ticket had been elected. The Federalist Governor recommended under the
circumstances that the vote!
rs of Dobbs County meet at the Courthouse in Kinston on an appointed day to elect
delegates. This meeting was held, but only 85 voters, all Federalists, participated in the
second election. The Hillsboro Convention unseated this Federalist delegation from Dobbs
and refused to seat the Anti-Federalist, as well. Dobbs County, therefore, was not
represented in the Hillsboro Convention which rejected the Federal Constitution.

I Benjamin Caswell Sheriff of Dobbs County Do hereby Certify that at the Time and place
mentioned on the Caption of the fore going List that I approved the poles & continued
the same agreeably to the law to which the general assembly on their Resolution refer and
as I'm set of the second day the poll was closed after three hundred & seventy two
persons had voted whose names are mentioned in the foregoing List, That on examining two
hundred & eighty two Tickets They appeared to be agreeable to the mark in the said
List so far as that number of votes given to each candidate I find this to be as follows
that is to say for

and sundry other persons a smaller number as appears by the said List that at this time to
wit, after taking out the 282 tickets, the lights were suddenly extinguished & the Box
forcibly taken from me in which were the remainder of the Tickets, by some persons to me
unknown, that there remained according to the foregoing absent account Ninety Tickets
uncounted, so that it was impossible for me to return any of the Number as duly elected
because there might have been a Insufficient Number in the Box, of the ninety remaining to
have given the Majority in favor of those who had not the highest Number so far as I had
proceeded to Count.
I further Certify that the Box in which the Tickets were put was originally calculated to
receive Votes for the Senate & Commons that there was a division in it and two Lids
that the Votes on this Occasion had been all carefully put into one side only, During the
reception of the Tickets the
other side being Sealed up, But that on taking out the tickets at the instance of some of
the candidates, the other side was opened and the Tickets when taken out & Counted
part therein to examine again to see if any mistake should have appeared, and this was
Quasioned but a dispute at a former Election where the tickets had been torn in two &
thrown away as Counted.
Thus I have stated the absolute Circumstances of the Case so far as I know or believe and
presume the Gen Convention will think me justifiable in not making any return in the
present instance.
