In the Name of God Amen I Benjamin Carpenter of orange County and
province of new york Being weak in body but of sound mind and memory
Blesses Be god Do Make and Publish this my Last will and testament
inform and Manner following to wit I give & bequeath to my Dearly and
well Beloved wife Mary one third part of all my movable Estate for and
during the time she continues my widow and no longer I Likewise Do order
and it is my will and pleasure that my said wife have the whole use and
benefit of my whole farm [and movable estate] for and toards the support
and maintanance of six youngest children till my Sone Benjamin arives to
the age of twentyone years and no longer Item I give and Bequeath to my
said sone Benjamin Eighty acres of the N E end of my farm adjoining all
along the Rode that Leads from the outlet northwestwards to him and his
heirs and asines forever Item I give & Bequeath to my two Sons, Gilbert
and Samuel all the Remaining part of my tract of Land to Be Equally
Divided Between them their heirs and asines forever it is also my will
that in Case of the Death of any of My Said three sons before they arive
to the age of 21 years or have Lawful issue that their part be Equally
Devided Between the Surviver or Survivers of them and their heirs and
asines for Ever Item I give and Bequeath to My three youngest Daughters
towit Sarah Mary and Rhodah the Remaining two third parts of all my
Movable Estate to Be Equally Devided between them their heirs and asines
for Ever and in Case of the Death of any of My said three Daughters
before they arive to the age of Eighteen years or Leave Lawful Issue it
is my will and pleasure that their part Be equally Devided

Devided Between the survivor or survivors of them their heirs and asines
forever I alls give and Bequeath to My Said Sone Benjamin My Small
Boared gun it is Likewise My Will and pleasure thay My Said Wife have
the use and and Benefit of the Best Room in the home, and Likewise to
one Cow Kept n the farm at her Discresion while she Remains my widow

I Do hereby nomenate and appoint My Loveing Wife Mary and My Loveing
Cousin Samuel Carpenter to Be My Whole and Sole Executors of this My
Last Will and testament hereby Revoking and Declareing nul and void all
all former Wills Whatsoever By Me Mad and Declareing this only to Be My
Last Will and testament in Witness Whereof I have hereunto Set My hand
and Seal this twentythird Day of february in the year of our Lord Christ
one thousand seven hundred and sixty four Sealed and Delivered in the
presents of us Who have Subscribed the same in the presents of the
testator as Witness

Be it remembered that on the Tenth Day of Octr One Thousand seven
Hundred And sixty seven personally came and appeared before me - - -
John Gale Surrogate of said County Isaiah Hallsted Farmer of Orange
County and Being duly sworn on his oath declared that he did see
Benjamin Carpenter Sign and seal the within Written Instrument
purporting to be the Will of the said Benjamin Carpenter bearing Date
the 23 Day of Febr 1764 and heard him publish and declare the same to be
and contain his last Will and Testament That at the Time thereof he the
said Benjamin Carpenter was of sound disposing Mind and Memory : to the
best of the knowledge and belief of him the deponent : And that his Name
Subscribed to the said Will is of his respective properHand Writing
which he subscribed to the said Will as a Witness there to in
theTestators Presence : and that he he Deponent said Henry Wisner and
John Carpenter smith The other Witnesses [to the said will] Subscribed
their Names as Witnesses thereto in the Testators Presence

Items that appear to have been inserted are transcribed in brackets. The
surrogate writes Richard Allison in probate, which should read Benjamin
Carpenter. Richard Allison's will was also probated in 1767 and his
son-in-law Samuel Carpenter was one of the executors of his will,
probably the same Samuel, and was probably a nephew of Benjamin, called
cousin here. Only his "six youngest children" and "three youngest
daughters" named here, indicating there may have been older children, or
at least one daughter not named.
