Charolette
Hi Bob,
Maybe this will help. See the information below.
No.. there is only one Andrew Carnahan in this instance. Why they show
him
deceased in the 1816 document I don't know.
Hope this helps a bit.
Take care - Emma
* 1816 - July 20 - Also Equity 6-86 filed 20 July 1816 - Logan Co.,
Kentucky:
William Marrs and Henry Billingsley, John Billingsley, Elizabeth
Billingsley,
James Billingsley, John Carnahan and Jane his wife formerly Jane
Billingsley,
Joseph Shannon and Polly his wife formerly Polly Billingsley, Samuel
Shannon
and Margaret his wife formerly Margaret Billingsley, and Hugh, James,
John,
Thomas and Polly Carnahan, all except William Marrs being heirs of
James
Billingsley who departed this life many years past leaving as his heirs
and
representatives the following children: Samuel, Henry, John, and
James
Billingsley,
Jane Carnahan the wife of John Carnahan, Polly the wife of Joseph
Shannon,
Margaret the wife of Samuel Shannon, and Elizabeth the wife of Andrew
Carnahan.
Samuel Billingsley has since died leaving Elizabeth Billingsley as
his
only
child. That Elizabeth Carnahan and her husband are also dead leaving
Hugh, James,
John, Thomas, and Polly Carnahan.
They represent and state that William Marrs and James Billingsley, their
ancestor, jointly in partnership purchased a large tract of land of
Richard
McMahon, lying principally in Logan Co., Kentucky. That Marrs and
Billingsley soon
after their purchase fully paid and satisfied McMahan the whole of
the
consideration, and there upon according to the terms of this purchase
became
intitled
to a deed of conveyance of the land. And that Mcmahan not finding
it
convenient at that time to make such deed himself did on 5 Jan 1795 by his
written
Power of Attorney, authorize and impower John Cos to conven the land
to
Marrs
and Billingsley. The Power of Attorney was acknowledged the same day
by
McMahan
before Gabriel Cox, who was then a Justice of Peace of this
Commonwealth.
On
25 Aug 1795 John Cox made a deed to Marrs and Billingsley, etc.
It has lately been suggested to them that the deed to Marrs and
Billingsley
was defective and did not convey to them the legal title to the land
and
the
Power of Attorney to John Cox was not made under the seal of McMahan,
etc.
Richard Mcmahan many years ago departed this life leaving William, John,
James,
Elizabeth, Jane, and Margaret Mcmahan as his children. That William
McMahan is
dead and his heirs are unknown. That Elizabeth married George Berry
and
is
dead without issue. Jan McMahan married David McFall and both of who
are
dead
leaving several children whose names are unknown. Margaret Enock
Berry
is
dead leaving several children whose names are unknown.

Returned by

summoning
James McMahan and Nancy McFall which are all the heirs known in his
baliwick.

are the
children
of Andrew and Elizabeth, dec'd, Hugh, James, John, Thomas, and
