A will of Real and personal Estate
In the name of God, Amen. I William Carmack of the County of Lee and State
of Virginia being old and growing weak in body, but of sound mind and
disposing memory for which I thank God and calling to mind the uncertainty
of human life, and being desirous to dispose of all such worldly estate as
it hath pleased God to bless me with, I give and bequeath the same in
manner following (that is to say) first: I desire that as much of my
perishable part of my estate be immediately sold after my decease . And
out the monies arising therefrom, all my just debts and funeral expenses be
paid. 2ndly after the payment of my debts and funeral expenses, I give the
same to my children herein mentioned equally to be divided among them.
Kisiah Hartsock, Benjamin Smith, Allen Carmack, Evan Carmack & Levi
Carmack. All the rest of my estate both real and personal of what nature
and kind soever it may not be herein before particularly disposed of I
desire may be equally divided among my several children herein before named
which I give -- (to?-- word began and crossed out) them their heirs
executors administrators and assigns forever. And lastly I do hereby
constitute and appoint my friend Levi Carmack my executor of this my last
will and testament hereby revoking all other or former wills or testaments,
by me heretofore made in writings whereof I have hereunto set my hand and
affixed my seat this 2nd day of January 1847.

At a Court begun and held for Lee County on the Monday the 15th day of
December 1851
The last will and Testament of William Carmack deceased was proved by the
oaths of Thomas J. Pridemore and Richard Crabtree witnesses thereto and is
ordered to be recorded and on the motion of Livi Carmack the executor
therein named who made oath thereto and together with William T. Martin his
security entered into and acknowledged a bond in the penalty of $500.
conditioned as the law directs, certificate is granted him for obtaining a
probat of the said will in due form.

Hope this has helped. I have a copy of the original handwritten pages of
the will made at the courthouse in Jonesville, VA. I have tried to refrain
from adding extra punctuation, capitalization, etc. Some of the writing is
hard to read. For example, I believe that the security for Levi (spelled
Livi in the original) Carmack was written as William T. Martin. However,
the middle initial could possibly have been "G".
Also, does anyone have any information at all on Kisiah Hartsock or
Benjamin Smith mentioned in the will? Most lists that I have seen list her
as Kisiah Carmack who married a Hartsock. Benjamin Smith is listed as a
son-in-law rather than a son. Since they are mentioned in the 1847 will,
both should have been around somewhere in the 1850 census. I have not
found then in Lee County.
