This is as much of the lawsuit as I have but it does give the date as

Hi Jane,
I have been thinking about the will of Thomas Sr. since receiving your
latest note. Searched through my records & this is what I came up with.
Children of Thomas Sr. & Mary Cardwell
Anderson. Caleb, Dudley, John, Leonard, Mary, Nancy, Nelson, Sarah
"Sally", Thomas Jr., Richard "Wilson", William.
In Dec. 1865 Court Case #147, NC Supreme Court of NC was filed Cardwell
heirs v. Brodie. Names were Mary Cardwell, execurix of Thomas, sons
Leonard & Thomas Cardwell appointed guardians of the said infants (under
age 21) that are represented to us as William, John, Wilson (Richard
Wilson), Caleb, Anderson, Dudley, Nelson, Mary, Sally & Nancy Cardwell.
A number of pages in this case were recorded in NC.
I got this information from an article in "Flashback Magazine" published
by Washington Co., AR Historical Society, May 1985 Vol. 35 pgs. 32-48 &
written by Robert Plumlee. I have corresponded with Robert, several
years ago, & he is my 4th cousin.
While his article doesn't give us any help on the parents of Thomas Sr.,
I think it does show that we are descendants of the same person. That is
progress to me!
