Since the Cardwell's & Overstreets are connected in the Smith Co TN area, I
thought I'd post the following that I found on the Overstreet list. Now you
know that the name Lockey came from the Overstreets!
I wonder if the wife of Leonard J. CARDWELL was an Overstreet? Her name was
Lockey L. and their daughter was Lockey R. Does anyone know if Leonard
married someone else by the 1870 census? He was listed with a Jemimah in that
census. Earlier census' list Lockey.
I'm still looking for any info on Thomas OVERSTREET who married Emily Watson
CARDWELL (both were apparently deceased before 1843).

Listed below - Major portions of the "Will of Thomas Overstreet" (some of
the document was torn and not decipherable).
Whereas Thomas Overstreet of the county of Mercer, Kentucky departed this
life in the year 1833 his last Will and Testament wherof he devised his
estate to his widow for and during her natural life and after she departs
therof to his son Aaron and whereas his son, Aaron presented to the Mercer
County Court for the record by John Overstreet another son of said Thomas
who and his other brothers and the said county court evidence for and
against the said will refused to administer. Wherefor the said Aaron payed
an appeal to the court and executed his bond as required by law. Now for
the said controversy and amicable adjusting all male relations thereto.
The above named parties Aaron Overstreet, Together with the said widow,
Judith Overstreet, at law of the said Thomas Overstreet (to wit), Lewis
Overstreet, Benjamin Overstreet, James Overstreet, Thomas Overstreet
(Jr), John Overstreet, Moses Overstreet, Buckley Overstreet and the
children and heirs of the Overstreet Deceased (Henry) and the children and
heirs of the deceased late Overstreet (Lockey) do hereby agree that all
controversy of said last will and Testament of Thomas Overstreet henceforth
and forever cease and that the same shall apply to the Court of Appeals for
record or to any other courts. The widow of said Thomas Overstreet shall
have for and during the term of her natural life the whole of the Tract of
land wheras said Thomas resided at his death and the two Slaves, Ned and
Marsh. Together the personal chattels of which the said Thomas deeded
payment of his first debt and it is further agreed that at the death of
said Judith ????????????? Aaron (?)promises to pay to the said parties, his
other brothers, within one year from the date hereof two hundred acres of
which property as it respectively come to the ????? of the heirs and shall
be sold for the best price that can be had and divided equally among the
heirs at law of said Thomas Overstreet and share alike. But it is
understood and agreed among the said heirs, they are not at any time to
sell any of the said Slaves to any one who will carry them or send them out
of this state as merchandise.
In testimony whereof the parties aforementioned have set their marks and
affixed their seals this 26 day of March, 1834.

The within Indenture was this day produced to me in my office and proven to
be the act and deed of John Overstreet, Aaron Overstreet with Lewis
Overstreet, Benjamin Overst reet, James Overstreet, Thomas Overstreet,
Buckley and Moses Overstreet parties thereto by the Oath of P. Michell a
subscribing witness whereto and the on the 9th day, the same was fully
proven by the oath of John Bilbo and others being witness thereto whereas I
have made the same recorded.

Probate Document, October, 1818
Know all men by these presents that I Thomas Overstreet of county of Mercer
and state of Kentucky have sold and by these presents do give, grant, and
convey until Aaron Overstreet one Negro boy, Ned, fifteen years old for and
in consideration of ?? shillings to me in hand paid by my son Aaron
Overstreet but it is understood that the said Aaron Overstreet my son is to
have no claim to said boy until decease of said Thomas Overstreet and wife
(Judith) at which he will be the property of Aaron Overstreet. I have
hereunto set my hand seal this 31 day of October, 1818.

(Son of Thomas and Judith Overstreet)
In the name of God Amen, I Thomas Overstreet of the County of Mercer being
sick of body but of sound mind and disposing of which I thank God and
calling to my certainty of human life and being deserving of all such
worldly estates as it has been blessed me with I give and bequeath in
manner following That is to say, I give to my wife Mary Overstreet all of
my estate and personal for and during the term of her natural life and
after her decease I give to my children. After the children that is with
me this time gets such a portion of my personal estate as I give those that
has married and left - to make them all equal The balance of my personal
and real estate to be equally divided between several children I also
desire That my whole estate, both personal and real after the death of my
Mary Overstreet be sold and the proceeds ensuing from them be equally
divided between my several children. I also desire that my three daughters
is with me at this time Mary, Martha and Ellen keep exclusef all of those
bed clothing they have made with their own hands. That to prase property
without the children having to make claims to rights from me. In witness
whenof ? set my hand and affixed my seal this 17th day of February in the
year 1854.
