DENT PARISH CHURCH PEW INDENTURE DATED 1759
THIS INDENTURE made the Twenty Second Day of February in the year of our
Lord one Thousand Seven Hundred and Fifty Nine and in the Thirty Second year
of the Reign of our Sovereign Lord George the Second by the Grace of Good of
Great Britain France and Ireland King Defender of the Faith and soforth
BETWEEN the Several Owners and Occupiers of Lands and the Tenements and
other the Inhabitants within the Township of Dent in the Parish of Sedbergh
in the County of York who Now have and Enjoy of Claim to have and Enjoy
Diverse Seats in the Church or Chapple of Dent in the said Township whose
Hands and Seals are hereunto subscribed and Sett of the one part And Matthew
Haygarth James Capstack Roger Hodgson of Holmside and John Hadwin
Churchwardens of the said Township for the time being of the other part
WHEREBY the several Owners and Occupiers of Lands and Tenements and other
the Inhabitants aforesaid whose Names are hereunto subscribed have come to a
Mutual Agreement to pull down take away and Remove the several Seats in the
said Church They now have and Enjoy or Claim to have and Enjoy and to Make
sett up and Erect New Seats in their Room and place at a joint expense to be
paid by the said parties whoever Names are hereunto subscribed in Equal
proportions according to the number of Seats Each party has and Enjoys or
Claims to have and Enjoy in the said Church NOW THIS INDENTURE WITNESSETH
That for the More Effectually Carrying the said Agreement into Execution
according to the true Intent and Meaning of the said parties They the said
Owners and Occupiers of the Land and Tenements and other the Inhabitants
aforesaid whose Names are hereto subscribed HAVE Authorized Empowered and
Deputed and by these presents Do Authorize Empower and Depute the said
Churchwardens their Executors Administers Successors and Assigns to apply
for Obtain and procure such faculty or faculties Licence of Licences as in
such cases are requisit or Necessary to be had and to pull down take away
all and every seat and seats the said parties Subscribed hereto now have and
Enjoy or Claim to have and Enjoy in the said Church or Chapple and to make
sett up and Erect New Seats in the room and place of such Seats so pulled
down taken away and removed as aforesaid AND the said parties whose Names
are hereto subscribed DO for themselves severally and respectively and for
their several and respective Heirs Executors Administrators and and Assigns
Covenant promises and Agree to and with the said Churchwardens their
Executors Administrators Successors or Assigns shall pay disburse and lay
out or Expend any Sum or Sums of Money in and about the obtaining such
faculty or faculties Licence or Licences as aforesaid or in and about the
pulling Down taking away and Removing all or any of the Seats aforesaid and
Making Setting up and Erecting New Seats in their room and place in the said
Church or Chapple or otherwise Concerning the premises aforesaid for
Carrying the said Agreement into Due Execution These the said parties whose
Names are hereto subscribed shall and will well and duly pay or Cause to be
paid Unto the said Churchwardens their Executors Administrators Successors
or Assigns their and each of their respective Share and Shares part or parts
of all and every such Sum and Sums of Money Costs Charges Expenses as the
said Churchwardens their Executors Administrators Successors or Assigns
shall pay lay out Disburse Expend or be put unto in about or Concerning the
premises aforesaid to be rated and settled at a proportionable pound rate
according to the Number of Seats each of the said parties whose names are
hereto subscribed now have of Enjoy of Claim to have or Enjoy in the said
Church AND for the Due Execution of the Cress...t ....... Names are hereto
subscribed doth bind himself herself his and her their Executors
Administrators Successors and Assigns to the said Churchwardens their
Executors Administrators Successors and Assigns by these present in the
........Sum of one Hundred pounds In witness whereof the said parties have
hereunto Interchangeably sett their Hand and Seal the day and Year first
above written.

On the right side of the church near the front and against the wall as one
walks down the aisle, is a set of seats with the Initals E.C. on them.
Edmund Capstack [my 6th Great Grandfather] is the only person with those
initals, in fact Capstacks are the only surnames starting with 'C' appearing
in the above 146 Signatories, a fair indication that it would have been his
family pew. George Capstack would have been my 6th Great Grand Uncle and the
first Capstick owner of Well Head. Edward, George, Thomas and James would
