Hi Lora,
This is completely different from what I was told of the commissioner's
office. I know an architect in Roswell who is very well versed in
preservation. I'll call him and see if I can find some more info.
My husband is a commercial builder. The last thing a builder
wants is a bunch of angry folks making waves. I feel like
a bull someone has waved a red flag in front of.
I'll help.
Carole

Al, I have been working on this since last Oct. with no luck so far.
Yes, the developer through his attorney has now told me his client does
not
own this property and that the previous owner also did not own this
property.
It's a long story so I will try to give you the short version.
I have told the developer, Mr. Gamal Tawfik, that I will maintain my
great-grandfathers cemetery as long as I am alive.
The problem I have is that GA Law 39-72 Abandoned Cemeteries and Burial
Grounds has a list of things that must be done when one is building on
property that has and old cemetery on it. This developer has done none of
these things!
The city of Jonesboro tells me different things on why this developer
does
not have to comply with Ga. Law 39-72.
1. this is a private cemetery (zoning & planning)
2. the builder when around the cemetery (zoning & planning)
3. the developer did not apply for a land disturbance permit (don comer,
city attorney)
And now the attorney for this developer wrote me a letter in which he
states
that his client does not own the cemetery.!!!
I am working on several others things at the present time to see what
happens, It is clear to me Jonesboro has no intention of making Mr. Tawfik
comply with GA. Law.
One last thing you may find of interest. This cemetery is in a deplorable
state, I brought this up when I had a face to face meeting with the
developer, his attorney, two other men that came with the developer, and
Mr.
Wayne Patterson, city of Jonesboro, what will people think when they
come
to
look at the property to buy a new home??? Mr. Tawfik had the last
laugh
(on
me). He was not worried. Tawfik then invited me along with my cousin
to
open
house in May.
When I made another visit to the cemetery in May, I found the cemetery to
have been completely cleaned!!! The attorney for Mr. Tawfik sent me a
letter
in which he stated that neither his client nor he had anything to do
with
this cleaning that Jonesboro does this yearly and had also provided this
service to the previous owner of this property. Are you aware of this
service that Jonesboro provides for private cemeteries? Jonesboro has not
responded to any of my letters. I will be happy to send you a copy of this
letter if you wish just let me know.
Keep looking for another article, I have other things working.......
Lora,
Kennesaw, Ga.
