File No. 926.--Calvert vs. Kennerley. Ross (Rolls?) Calvert and Charles
Harper complain that on 19th September, 1794, George Calvert purchased
of James Kennerley, since deceased, a tract in Culpeper County--325 acres.
George assigned the title bond to orators on 29th March, 1806. Kennerley
died testate. Will recorded in Staunton District Court, but died intestate
as to this land. James Kennerley's son, Benjamin, has died intestate and
without issue. James left other issue, viz: Sons James, Thomas, Samuel;
Mary Lockhart, then wife of Patrick Lockhart, but now sole; Elizabeth
Poindexter, wife of Joseph Poindexter; William and Reuben; Kitty Craig,
wife of George Craig. William and Reuben and James have made a deed
to orators, but were without title. The heirs reside partly in Virginia
and
partly in other parts. Thomas resides in Kentucky. Spa. dated 23d August,
1810.

I, Andrew Bushong Senior, of the County of Shenandoah and State of
Virginia Do make and publish this my Last Will and Testament Hereby Revoking and
making void all former Wills by me at any time Heretofore made as to such
Worldly Estate as it hath pleasured God to intrust me with, I dispose of the
same as follows, VIZ:
FIRST, I direct that all my debts and funeral expenses be paid as soon
after
my decease as Circumstances will permit.
SECONDLY, I direct that a fair valuation or appraisement be made by three
judicious neighbors of all the moveable property which may be found belong
to my Estate and the said property to be disposed of at Public Sale and
the
proceeds of said sale together with all money bonds notes, etc.,
appertaining to my Estate should be disposed of as I now direct.
THIRDLY: I now direct that my further Will is that I give and bequeath to
my
four son's VIZ; Jacob, William, David, and Henry, each of them Seven
Hundred
and Eighty Dollars including that which they have already received and to
my
son John I give and bequeath Nine Hundred Dollars including that which he
has already received. And to my grandson Henry W. Snapp I give and Bequeath
three hundred dollars and to my Daughter Sarah I give and Bequeath Seven
Hundred and Eighty Dollars including that which she has already received and
to my Daughter Elizabeth I give and Bequeath Seven hundred and eighty
dollars including that which she has already received.
FOURTHLY: I further Direct that to my two sons, VIZ; Andrew and Isaac I
give
and bequeath the farm on which I now live and Have divided the same and
allotted to my son Andrew that part of the farm joining the parish farm
and have allotted to my son Isaac that part of the farm joining Toms Brook
and I also give and bequeath to my two sons Andrew and Isaac that timbered
land laying near Maurertown said land shall be equally divided between them
by three judicious neighbors.
FIFTHLY: My further Will is if there be a remainder of funds after
complying
with the first, second and third parts of this Will, I direct that it
shall
be equally divided between my five Sons and two Daughters, VIZ; Jacob,
William, David, Henry, and John, Sarah and Elizabeth.
SIXTHLY: I do hereby make Ordain, Constitute and appoint my three sons,
VIZ;
Andrew, John, and Isaac Executors of this my Last Will and Testament
Hereby
Revoking all former wills by me at any time Heretofore made and Do declare
this to be my Last Will and Testament.
In Witness Thereof, I, the said Andrew Bushong Senior, have to this my
Last
Will and Testament set my hand and Seal this 21 day of December 1852.

At a Court Held for the County of Shenandoah on Monday the 7th day of
March
1853.
The Last Will and Testament of Andrew Bushong deceased was produced into
Court and proven by the oaths of George Gochenour and John S. Scott
Witnesses thereto and Ordered to be recorded. Andrew Bushong and Isaac Bushong
two of the Executors therein named refused to take upon themselves the burden
of the execution thereof and on motion of John Bushong, the other executor
named who was present and with Abraham Bauserman, Adolph Heller and Peter
Dole as his
Securities executed this bond on the penalty of Six thousand six hundred
dollars, which bond is approved.
Certificate for obtaining a probate thereof in this sum is granted him.
