I thought I might add my own two cents to this discussion. I once was accused of
posting material to the webb by an old boy who is a member of our list. I won't
mention his
name, but this caused me to consult my favorite barrister and bar- hopping buddy
whom I was aware had handled three such cases that I knew of from his stories
retold around a bonfire on the eve of OU football games and somehow retained
in my foggy memory of those less than memorable nights.
In essence this is what he told me. Anything which is public knowledge or public
information;
that is contained in documents in the court house, census records, birth, marriage, or
death
records including stories published in newspapers is not copyright infringement and may
be
used freely without reference to where you obtained the information. (It is a good idea
to make
a note to yourself where you got the information in case it is wrong, so that you may
contact the
source.)
On the other-hand, if personal information in the form of a story known only by the author
or
which has been related to the author of the copyrighted information is reproduced within
your
work, then you must have their written permission to publish it if that is your intent.
If there is anyone who disagrees with my interpretation, to bad. My barrister has gone on
to
a better home and is not available to argue the points for me. (That is if there is a
better home
for barristers.)

Nancy J I have always heard from Genealogist that one can give information
in short from another persons work as long as you give the author and
publisher credit. Add date of Copyright. so person reading it will know it is
copied from a copyright source. It is not legal to publish them in a book or
for sale information with out written permission. Bettye

of David's grandfather, old David Cagle in Mecklenburg (present Cabarrus
County, NC. by 1830, David Cagle 1767-1852m was in Henry County, Georgia
along
with Leonard Cagle, 1770-1840's, who had been the L Cagle of 1810
Montgomery, NC.
