Book 1839 M pages 153/4 on 28 October 1840 DANIEL SCOTT sold George Etter for
$637.50 180 acres on Collins River where Scott lives adjoining DAVID BROWN
and Peter HUTSON & James VICKERS it being the land conveyed by Henry J. A.
Hill to DAVID BROWN'S heirs 3 March 1825 in Book 1831G pages 10/11. Deed Book
1839M pages 377/8 on 3 March 1841 DANIEL SCOTT made deed to George Etter for
100 acres adjoining the place Scott LIVES ON #3232 dated 26 February 1831: 3
beds & furniture, 2 chests, 1 cupboard, 10 cattle, 1 yoke oxen, 1 bay mare, 6
cows, 3 pair _____, 125 head of stock hogs, 14 bee stands, 7 axes, 1 mattock,
also 70 ACRES on the river SCOTT lived on at $2 per acre & totaling $180
because he owes George Etter $14 and Henry Etter $4 due on or before 19
December the next [1841].
The March Term of 1847 Chancery Court at McMinnville, TN the following decree
was rendered: George Etter VS DANIEL SCOTT. Daniel Scott, THOMAS SCOTT &
Jenny his wife lately Jenny Brown, Philip BEESLEY & Peggy his wife, Aaron
Culberson & Cyrena his wife, Cargle and _____ his wife, Polly Brown, Sherwood
Brown & Greenberry Brown. On 23 March 1847 Chancellor Ridley heard the cause
against Daniel Scott & the balance of the defendants except Culberson & his
wife Jincy? who ____ their answer & publication & proof. It appeared to the
court that the defendant Daniel Scott was the LEGAL OWNER of all the shares
of the defendants int he lands in dispute by purchases from them & that said
defendants had received from Daniel Scott the ____ for the same. The said
Jincy Culberson having sold her interest in the land in dispute to THOMAS
SCOTT & that he had sold the same to DANIEL SCOTT and it further appeared to
the court that the said DANIEL SCOTT had possession of said land for more
than 7 years previous tot he said complaint Etter having taken the mortgage
at the price of $400 & upwards & that the said Etter has had possession of
the same ever since. It is therefore decreed that all claims be divested out
of the said defendants & vested in complaint Etter. Satisfied that said
DANIEL SCOTT had possession of the title papers relinquishments deed for all
of said tracts had refused to surrender them to Etter in order that the same
might be registered but instead fraudently concealed or destroyed the same &
that the said Galliher & Jincy his wife fraudently combined & confederated
with said Daniel Scott to cheat & defraud said Etter out of said land. Etter
to pay the cost in the first instance and that he have a decree over against

Penelope Allen of Chattanooga, TN had a query in 1935 from F. B. of Spokane,
Washington: Sherwood Selma Brown born 3 February 1814 McMinnville, TN son of
David & JANE GORDEN Brown. David Brown died and his widow Jane wed as her 2nd
husband THOMAS SCOTT about the year 1828. Daniel Scott wed Nancy Brown who
was born ca 1802 in Cumberland Co., KY to David Brown [who may have been the
man marrying Jenny Gorden February 1800 in Cumberland County, KY]. According
to the deed David Brown had heirs: Sherwood, Greenberry, Cyrena who wed Aaron
Culberson, Peggy/Margaret who wed Philip Beesley?, Jincy who wed a Cargil
[Cagle?], Mary Polly Brown, Nancy who wed DANIEL SCOTT. There was an Aaron
Culberson listed 1840 Stewart County, TN #329 with family 012001-000001
