This conversation is rather old and redundant. There are many websites on
the Internet addressing the legalese of copyright. It would behoove us all
to do a little extra reading. Trying to protect the submitters rights is a
fruitless adventure as no court will recognize the USGW as an entity of
representation. Any individual has the responsibility for their own
material. The USGW can only provide assurance in its own behalf.
Trying to "protect submitters' data" can be accomplished with simplicity by
using the following:
"This site is intended for use by the general public. It is, however, the
exclusive property and responsibility of the USGenWeb Project .
Reproduction of this website for personal or commercial use is strictly
prohibited by copyright laws."
Herein lies the true meaning that should be conveyed to contributors. If
they choose to share their material with the Archival administrators, then
this can only be considered a personal decision and should not be construed
as a guarantee of copyright protection.
The basic point of interest remains: "Public data cannot be copyright
protected. The presentation of the material in specific format is analogous
to the individuals efforts to consolidate those facts."
